It is further alleged that, by colluding with real-estate criminal elements, he has illicitly caused the construction of roads and the installation of street lights on the said land for his personal gain. Despite the pending criminal proceedings under the Indian Explosives Act, and notwithstanding the existence of investigation and restraint relating to the property, he unlawfully organized and held public assemblies on the subject land, and caused the activation/installation of street lighting, thereby effecting further unauthorized changes to the site.
It is also alleged that my petition submitted to the Director General of Police, Tamil Nadu, in relation to the foregoing matters has come into Aravind Ramesh’s possession under circumstances that require inquiry. Moreover, while the matter remains sub judice and is the subject of proceedings under Section 164 of the BNSS Act, 2023 , he procured, facilitated, or permitted the unlawful holding of public meetings and the commencement of street-lighting works on the same land, in breach of the ongoing legal process.
§In light of the foregoing, it is prayed that a thorough and impartial investigation be directed to determine
how the petition addressed to the Director General of Police, Tamil Nadu, was obtained or came into the hands of Aravind Ramesh.
whether acts were committed with the specific intention of destroying or concealing evidence relating to the proceedings under the Indian Explosives Act.
the role of real-estate operators or organized criminal elements in effecting unauthorized construction, road formation, and installation of street lights on the subject land for the personal benefit of Aravind Ramesh
whether any offences under the Indian Explosives Act, the BNSS Act, 2023 (including Section 164), or any other penal or statutory provisions have been committed in respect of the above acts; and
the steps necessary to preserve, protect and restore the integrity of the subject land and any evidentiary material, including interim measures to prevent further alteration, demolition or concealment.
It is further prayed that, pending investigation, appropriate directions be issued to restrain any further unauthorized works, public assemblies, or installations on the subject land; to secure and preserve the site and any objects or documentary evidence found thereon; and to take such further action as may be necessary in law.
